A GROUP of seven young males trapped a 21-year-old woman in her laundry before raping her while her children slept nearby, a Bendigo court has heard.

The males, aged between 14 and 21 and who came to Australia as refugees, yesterday applied for bail in the Bendigo Magistrates' and Children's courts.

Police told the hearings that the group of seven went to Bendigo from Shepparton to go nightclubbing last Saturday.

They have each been charged with 17 offences, including rape and assault.

Detective Senior Constable Christopher Reed of the sexual crimes squad said the alleged victim, who lives locally, left her children with a babysitter while she went with a friend to two Bendigo clubs, the HuHa Club and the Star Bar.

As she was leaving the Star Bar at about 2am, she met a 16-year-old girl, who introduced her to the group. The men then went back to the woman's house, joining the 16-year-old girl and the babysitter there.

Peter Baker, the lawyer for one of the men , said evidence from the babysitter portrayed a party that was "initially . . . pleasant".

Constable Reed said the victim began to feel unsafe when one of the teenage men became aggressive, putting his arms around the victim.

A video recorded on one of the men's mobile phones shows the victim being grabbed in her kitchen, with the 16-year-old trying to pull her into the laundry.

"She can be clearly heard saying no," Constable Reed said.

The footage showed the 16-year-old and 14-year-old persisting in trying to shepherd the woman into the laundry while she pushed them away.

Mr Gar allegedly lifted the victim's skirt and pulled her underwear down while she tried to kick him away.

Constable Reed said the group was laughing while Mr Gar digitally raped the woman.

She was then taken into the laundry where  she was held down by two men while she was raped by two others.

Detective Reed said the woman's screams could be heard from outside the laundry.

The woman went to her bedroom and called police, who arrested all seven at the house.

Mr Baker said the evidence of the babysitter, who described the group being in the laundry for about 30 minutes, portrayed a less serious situation than police described.

One of the accused men told police his friends and the victim were "having a little wrestle" and "grabbing each other like a porno", and she was not really fighting back, but "more like a play".

Constable Reed said the victim was "extremely fearful" for her safety and her children if the men received bail.

Bail was granted for three of the accused men, while the rest have been remanded to appear again next week.

ONE election result is already clear - and makes this debate about Tony Abbott's "secret" plans even more brainless.

Wake up, people. The Greens will have the balance of power in the Senate.

Labor sealed that deal when it agreed to swap preferences with a party which its wiser heads know would devastate the economy if it could.

That's politics, I guess.

Winning is all, and to hell with the national interest. But how grotesquely irresponsible?

Labor is helping into power a party which demands we scrap our power stations and close industries that earn us at least $60 billion a year.

Oh, and it wants us all to have more holidays, because hard work and making money really sucks.

Some 12 per cent of voters say this is just the party for them, and even Labor now says it's the best of the rest.

Yes, that really is how infantile our society, and our politics especially, has become.

But Labor, whose primary vote has been unusually low, says this only because it badly needs Greens preferences.   In exchange, it's agreed to help the Greens save its own five Senate seats - and to probably win a couple more.

It was already inevitable Labor would win back some Senate seats from the Coalition.

But this deal also kisses goodbye to Family First Senator Steve Fielding, who lucked his seat in 2004 when Labor absentmindedly preferenced him but will lose it now Labor is steering votes to the Greens.

That will be all it takes. After this election, no government will be able to pass a law against the opposition's objection without the support of the Greens, and Greens alone.

Never has this party had such a great chance to inflict on us policies that many voters treat as position statements, rather than a deliberate manifesto for the deindustrialisation of our economy and the tribalising of our society.

This now is the real issue: How much of our future did Labor sell off just to get these Greens' preferences?

Never mind this week's scare campaign about what workplace laws Abbott might secretly plan. The hapless schmuck couldn't get them through a Greens-Labor Senate even if he wanted to.

No, what really needs debate is what the Greens might now demand from a Gillard Government in exchange for its vote. And that, in turn, needs journalists especially to take seriously this party's policies.

The Greens' manifesto is not written down for a joke. It is the serious work of ideological warriors hiding behind Bob Brown's amiable front.

Vote Greens in this election and you won't get cuddlier koalas, bigger hugs and cleaner rivers. In fact, you'll be voting to "transition from coal exports", which means ending a trade worth $55 billion a year .

You'll be voting to end "the mining and export of uranium", worth $900 billion a year. You'll be demanding farmers "remove as far as possible" all GM crops, which includes cotton worth about $1.3 billion a year.

You will be voting to close down many other industries, including export of woodchips from old-growth forests, certain kinds of fishing, oil and mineral exploration in wildernesses, and new coal mines.

You'll even be voting to close the Lucas Heights nuclear facility, even though it actually produces treatments for cancer.

In fact, you'll be voting for policies deliberately intended to make us poorer. Less industrialised. Or as the Greens' policy puts it, for a "reduction of Australia's use of natural resources to a level that is sustainable and socially just".

Maybe you think it won't matter if a few industries get shut. Maybe you really are that stupid. But you haven't heard the rest of the Greens' policies yet, have you?

You see, the Greens also plan to shut coal power stations that produce 80 per cent of our electricity. They not only "oppose the establishment of new coal-fired power stations" - claiming they make the planet dangerously hot - but intend to ban new coal supplies for those we already have. And they'll hit power stations with a new tax to make electricity too expensive for you.

Do you have any idea how many businesses would be driven broke by this Green frolic? How many hundreds of thousands of jobs would be lost?

If you think the Greens must have alternative power sources in mind, you're dreaming.

The Greens want to keep Labor's ban on nuclear power. They even want to scrap government-funded research into carbon capture.

So consider. If the Greens get their way we'll have huge industries banned, businesses driven broke and power prices driven through the roof, with not enough electricity for what industries will be left.

So, with our income slashed to ribbons, what do the Greens propose? Not deep cuts in every government program but a spending spree to make Kevin Rudd seem a miser.

It's free money for everyone. If you vote for the Greens, you're voting for an extra week of holidays for all, "mandated shorter standard working hours", more pay for women workers, higher pay for casuals and better weekly benefits to students and artists.

More pay for less work, at the mere stroke of a Green pen. Isn't that a darling way to reorganise the economy? What could possibly go wrong?

They promise to lift foreign aid to "a minimum of 0.7 per cent of GDP by 2010", which means an instant rise in handouts of $4 billion a year.

Another $2 billion a year will go to scrap tertiary fees and forgiving all HECs debts.

The Greens lazily assume that the bill will be covered by hiking corporate taxes, hitting the richer 5 per cent of Australians with wealth taxes, and slugging air travellers. Show us your costings, Bob.

I'd be amazed if after a year of two of this that anyone would want to come to a country which by then would be a smoking hole in the ground.

Yet the Greens plan to do their best to attract more people to their new nation of freeloaders. Any "asylum seeker" making it here by boat would be freed into the community within 14 days, security checks permitting, and rewarded with benefits, medical services and school for children. These goodies will be offered to "environmental refugees", too.

A new, militant industrial agenda is also buried in this New Age madness, signalling the arrival in Brown's party of "watermelon Greens" - green outside and red inside.

These, like NSW candidate Lee Rhiannon, seem Green more of convenience than faith, using this doctors' wives party to smuggle in the kind of hard-Left politics that would scare voters if they saw it coming under a hammer and sickle.

This is what a vote for the Greens really means. And it's this party of vandals, tribalists and closet totalitarians that shameless Labor now helps to such threatening influence.

A MAN alleged to have bashed Labor MP Paul Gibson in a Macdonald’s carpark has been arrested and charged with common assault and assault occasioning bodily harm.

The Daily Telegraph revealed the assault on Mr Gibson last week, in which Mr Gibson alleges the man shouted: “This is how we do it in America, this is how we do it in America” as he bashed the Blacktown MP.

I guess Mario Norman had to wait until his foot “got better” before he could walk into the Police station.

A police spokesman said a “24-year-old US national” had presented at Manly police station this morning with his solicitor David Leamey and was arrested and charged.

The singer-songwriter, currently in Australia on a tourist visa, was bailed and will appear before Manly Local Court later this month.

The MP claims to have had his ribs broken in the scuffle.

He said the fight started after the American claimed Mr Gibson drove over his foot as he went to park in the carpark in Thornleigh last Sunday.

I am of two minds over this incident ,I mean,he only did what millions of Australian’s have wanted to do to many of our politicians for years, especially those on the left,its fitting that a Labor (left) politician gets a flogging from a “singer songwriter” from the USA.

I know, I know we should not go around bashing the crap out of our Politicians, even Labor ones, but gee It’s a good feeling to know that at least one of the bastards has copped a flogging off some deranged arse clown,Gibson will at least now be able to look his electorate in the eye and honestly say he has something in common with the average Australian, ie. he too has been bashed sensless by a foreigner.

WHAT you were matters less than what you are, so it can't hurt Julia Gillard to admit her past -- and reject it. Then why won't she?

Fact: for at least eight years the deputy Labor leader was an official of the hard-Left Socialist Forum.

Here's how Melbourne University's archives describe her group:

"The Socialist Forum was established in 1984, initially by disaffected members of the Communist Party of Australia (CPA). Its membership included Australian Labor Party (ALP) members and political activists . . .

(Its) stated aim was to contribute to the development of democratic socialism in Australia . . ."

And one of its unstated aims was to help former communists join Labor.

Back then Gillard had no trouble admitting to that communist influence, writing in an SF pamphlet: "Around 45 of the forum's members left the Communist Party of Australia in the division of a year ago . . ."

She'd know. She not only wrote such pamphlets for the SF's 200 or more members, but worked until 1993 -- when she'd already become a lawyer -- as its organiser and then on its management committee.

The policies she pushed were the usual sandwich-board stuff: scrapping our US alliance, super-taxing the rich, introducing death duties, blah blah. But here's a novel one: twinning Melbourne with Leningrad -- renamed now, post-communism, St Petersburg.

Of course, most of us grow wiser with experience and -- note well, young radicals -- leave such heady but ruinous Leftism behind.

But has Gillard? It's a fair question to ask someone who wants to be our deputy prime minister, in charge of workplace "reform", especially when she's part of a Labor team of which some 70 per cent are ex-union officials.

But here's the troubling thing about her replies. Far from repudiating her past radicalism, she refuses to even admit to it. Here, for instance, is part of her interview on the ABC's Lateline program on Wednesday:

Gillard: I was a full-time university student and I had a part-time job for an organisation called Socialist Forum, which was a sort of debating society . . .

Interviewer: It wasn't a front organisation for communists?

Gillard: Certainly not. It was an organisation where people who identified themselves as progressives, some in the Labor Party, some outside the Labor Party, would come together and would talk about ideas. I did clerical and administrative work . . .

Good skills with that airbrush, Julia.

Gillard -- a long-time official and a leader of a group created by communists -- is transformed. In her new version, she becomes just a part-time typist in her "student days" for "progressives", who merely debated stuff. Her communists become simply people "outside the Labor Party".

That's neither frank nor, I suggest, quite honest. And when asked a direct question . . .

Interviewer: Are you now, or have you ever been, a member of the Communist Party?

Gillard: Tony, I think that question shows how silly all of this is getting, though I suspect in this interview, probably the Howard Government would think you're the dangerous radical. After all, I'm only from the Labor Party, you're from the ABC.

A "no" would have been shorter. But more importantly, can Gillard now own up to her past radicalism, and explain how she came to reject it?

After all, she's still of the Socialist Left and as Labor's health spokesman at the last election offered us the Whitlamesque Medicare Gold disaster, after choosing as her leader the anti-American Mark Latham. She has some reassuring to do.

SCRAPPING the ANZUS treaty, twinning Melbourne with Leningrad and introducing a super-tax on the rich were among radical policies devised or backed by Julia Gillard as a student activist.

Labor's deputy leader was a key figure in a socialist group that pushed radical policies and social agendas in the 1980s and early '90s.

Founded in 1984 as a pressure group within the ALP, the Socialist Forum also wanted to sever Australia's alliance with the US, remove the spy base at Pine Gap, introduce death duties and redistribute wealth from the rich to the poor.

The Sunday Herald Sun has gained access to the forum's archive - held in the Baillieu Library at the University of Melbourne.

The archive contains material revealing the radical past of Ms Gillard, including her links to former members of the Communist Party of Australia.

Ms Gillard, who could be Australia's next deputy prime minister, was on the management committee of the forum for many years. She acted as its public officer, secretary, and legal adviser on the drafting of its constitution.

Her signature is on liquor licence applications for the forum's social events, such as theatre nights.

In a pamphlet from the mid-1980s, Ms Gillard describes herself as a "socialist and a feminist" and someone who joined the ALP at 16.

"Contrary to what may have been suggested, Socialist Forum is not a secret organisation nor is it a sub-caucus with the Socialist Left," Ms Gillard says in the pamphlet.

"The members of the forum are drawn from varied backgrounds. Around 45 of the forum's members left the Communist Party of Australia in the division of a year ago and about 80 are members of the ALP. The largest group are not members of any political party."

The 200-plus member forum sought to influence Bob Hawke's Labor government, especially on foreign and economic policy, through the free discussion of ideas.

One key document is the 1985 "Pine Gap - Planning a Strategy", drafted by Philip Hind, who recommends a long-term policy of abrogating the ANZUS Treaty, removing Pine Gap and eventually closing all US bases.

Mr Hind visited the former Soviet Union and came back praising the reforms of president Mikhail Gorbachev. He recommended stronger ties with the USSR, including making Melbourne a sister city of Leningrad (now St Petersburg).

The archive also reveals the forum's debate over tax policy was based on a Communist Party tax pamphlet titled "A Case for Radical Tax Reform".

"We argue that there is only one effective way to reform the tax system, by a sweeping redistribution of the tax burden which now hits hardest at low and middle-income earners," the pamphlet says.

Health Minister Tony Abbott has accused Ms Gillard of erasing her radical past and her links to the forum.

Yesterday, Ms Gillard said she could not remember the forum discussing radical policies. "It did not adopt policy positions and I don't remember any of the papers being referred to," she said.

Her Who's Who entry for 2006 contained no mention of her role in the Socialist Forum.

Yesterday Ms Gillard said she could not remember it discussing radical policies.

"The aim of Socialist Forum was to foster debate amongst progressive Australians and consequently it distributed, for the purpose of discussion, the writings of many authors," she said.

"From the summary of the papers provided I do not endorse their content now and would not have endorsed their content in 1985 as a 24-year-old."

 

Julia Gillard has denied being a communist

DEPUTY Opposition leader Julia Gillard said today she was not a communist and never had been.

But she said at the same time as she was a member of the group Socialist Forum, Treasurer Peter Costello was flirting with the Social Democrats, a group that also included socialists.

Ms Gillard accused the Government and Mr Costello in particular of running a pretty silly scare campaign.

Ms Gillard agreed her membership of Socialist Forum had continued while seeking Labor preselection. She entered federal politics in 1998.

“My membership of Socialist Forum did continue for a period but let's be very clear about what Socialist Forum was. It was a debating society that ultimately amalgamated with the Fabian Society,” she told Channel 10 today.

“The Fabian Society of course has been around, well, forever. It has been in British politics before it was in Australian politics.”

The Government has persistently attacked Labor for the number of unionists within its ranks, accusing it of being anti-business.

Treasurer Peter Costello said Ms Gillard was a union lawyer and organiser for Socialist Forum, an extreme left wing group which included remnants of the communist party.

Ms Gillard said, interestingly, it had now been revealed Mr Costello was himself hanging out in a group called the Social Democrats when he was at university.

She said that organisation brought together various people including those who described themselves as socialist.

“So if we all want to go back to people's university days and talk about when Peter Costello was flirting with joining the Labor Party, when Brendan Nelson was in the Labor Party, it's going to be a pretty silly debate,” she said.

Ms Gillard said Socialist Forum was never part of the Labor Party.

“We would bring people together for discussions. It would periodically publish papers that would be there for people to consider, the kind of stuff that the Fabian Society does today,” she said.

Asked outright if she was a communist, she replied, laughing:

“No of course not and guess what I never was, despite Peter Costello's obsessive and silly fantasy,” she said.

“Let's be real about this. We are talking about an election in 2007, an election where we are presenting policies and plans for this nation's future.”

Ms Gillard said Prime Minister John Howard and his Government were obsessed by the past.

She said Mr Costello actually thought it appropriate to spend days talking about events nearly 20 years ago at a time when he was in a group called the Social Democrats.

“That silliness is irrelevant,” she said. “I reckon it has got a scare campaign and a pretty dumb one.”

AN ADDICTION to marijuana has halted one of the notorious Skaf gang rapists from being released on parole for a second time.

Mahmoud Sanoussi was one of 14 men who gang-raped a young woman 25 times a decade ago.
Although jailed for 11 years, he was paroled last May after showing remorse and admitting his guilt.
But court-ordered drug tests revealed Sanoussi had tested positive to cannabis use four times since October, which led to his freedom being revoked in March.
Appearing via video link from Long Bay jail yesterday, Sanoussi pleaded with the parole authority to give him "one last chance to prove himself''.
He told the authority last week he was prepared to abide by a curfew or wear a surveillance bracelet.
His solicitor Louise Coorey added that her client had also sought work while in custody and had received numerous offers of employment.
Authority Judge Terence Christie ruled he had breached his parole too many times to warrant release for a second time.
The parole board will meet again later in the year to discuss Sanoussi's progress in custody and will determine eligibility for release in March 2011.

THE first of the notorious Skaf gang rapists is to be recommended for release from jail next month after receiving a discounted sentence.
Mahmoud Sanoussi was one of 14 men who gang-raped a teenage girl 25 times in western Sydney.
He was jailed for 11 years but is eligible for parole after receiving a discounted sentence because he pleaded guilty and showed remorse.
Sanoussi, 23, appeared via video link at a State Parole Authority hearing on Friday where submissions were made to release him back into the community. The decision was adjourned to next month.
"We've asked for further documents, further material,'' a spokesman said.
The authority will take into account his rehabilitation and his behaviour in prison.
But Sanoussi's possible release has sparked grave concerns from Corrective Services Commissioner Ron Woodham, who has stepped in to try to keep one of the country's worst gang rapists behind bars.
Mr Woodham believes Sanoussi is a risk to society, and is preparing a formal submission to be presented to the NSW State Parole Authority.
Victims groups share his concerns, saying yesterday that Sanoussi's release is too soon.
Sanoussi, aged 15 at the time of the attack, and his brother, Mohammed, were part of the "brutal gang of rapists'' who terrorised a young woman in Sydney in August 2000.
The gang took their victim, Miss C, to a toilet block where Mohammed Skaf asked her if she liked it "Leb style'' before raping her. He left the cubicle and Sanoussi (Mahmoud) came in and raped her.
For the next six hours, Miss C was subjected to multiple rapes and death threats at three isolated locations.
Ringleader Bilal Skaf was sentenced to a record 55 years jail. His sentence was halved on appeal.
Sanoussi was jailed for a maximum 11 years with a six-and-a-half year non-parole period.
NSW Rape Crisis Centre manager Karen Willis said she was concerned about his release.
The victims of the gang rapes would also be in fear.
"It was a vicious, appalling crime,'' Ms Willis said.
"If we are going to release serious sex offenders back into the community, we need to be absolutely sure that they are completely rehabilitated and no one is going to suffer in such a way as their victims did.
"Unless they're absolutely sure, then they can't release him.''
Miss C, who moved overseas, is still recovering from her ordeal.
If granted parole, Mr Woodham has the power to apply to the Supreme Court to keep Sanoussi in jail, following changes to the NSW Serious Sex Offenders Act to allow for continued detention of an offender past their release date "for the safety and protection of the community''.
During the sentence of the Skaf gang rapists, the judge described their crimes as worse than murder.
"These cases concern one of the greatest outrages, in criminal terms, that has been perpetrated on the community in Sydney ... military organised gang rape involving 14 young men,'' Judge Michael Finnane said in 2002.
Sanoussi served part of his sentence in juvenile justice before moving to an adult prison.

Bilal Skaf, the leader of a Lebanese gang which perpetrated racially motivated pack-rapes on Australian teenage girls in Sydney in 2000, was last week sentenced to a further term of imprisonment. Added to the the 28 years he is serving for other pack-rapes, his maximum term is 38 years.
His younger brother and accomplice Mohammed was sentenced to 15 years jail. With other sentences he will serve a maximum of 26 years.
To show their disdain for Australian culture and Australian females, gangs of Lebanese Muslims carried out violent, racist pack-rapes on young Australian girls around Sydney in 2000. Over 50 young girls were pack-raped during this rampage.
Bilal Skaf, the leader of one gang organised the pack rape of a sixteen-year-old girl known as Miss D near a soccer field in the Sydney suburb of Gosling on the night of August 12, 2000. Fourteen Lebanese youths-pack raped Miss D that night.
Nine of the men were brought to trial. Skaf made history when he was sentenced to 55 years jail. He appealed, and the conviction was overturned on a technicality. On April 18 this year a jury finds the brothers guilty for the second time.
Justice Michael Finnane who presided over the Skafs' trial, described the assaults, in August 2000, as "one of the greatest outrages in criminal terms that has been perpetrated on the community in Sydney ... militarily organised gang rape involving 14 young men".
"What this trial showed was that he was the leader of the pack, a liar, a bully, a coward, callous and mean," Finnane said of Bilal Skaf. "He is in truth a menace to any civilised society".
Apart from the Skaf brothers, those sentenced on October 11, 2002 following the original trial were:
    * Belal Hajeid, aged 20, sentenced to 23 years
    * Mahmoud Chami, 20, sentenced to 18 years
    * Tayyab Sheikh, 18, sentenced to 15 years
    * Mohammed Sanoussi, 18, sentenced to 21 1/4 years
    * Mahmoud Sanoussi, 17, sentenced to 11 1/4 years
    * 'H', 19, sentenced to 25 years
    * Mohamed Ghanem, 19, sentenced to 40 years
Skaf is a weedy little bastard. Over the next 30 years he will most likely get a greater appreciation of the impact of rape.

Explosive argument behind Trad's defamation reasoning

The man carrying a legal bomb into courtroom 11A in the NSW Supreme Court building on Friday morning did not look menacing and is not menacing under normal circumstances. But these were not normal circumstances. This was cultural war. The legal bomb was brought to court by the once leonine figure of Clive Evatt, a veteran defamation lawyer who now walks with the aid of a cane, on which his severely bent frame leans heavily.

As Evatt took his place at the plaintiff's bench, the man on whose instructions he was acting, Keysar Trad - a thickset, bearded man wearing a grey suit, blue shirt and tie - sat alone in the back row of the public gallery.

Trad is no stranger to litigation. Over many years he has expended untold hours making formal complaints to the NSW Supreme Court, the Administrative Decisions Tribunal, the Anti-Discrimination Board, the Human Rights Commission, the Press Council, other review bodies and, above all, the media, where he has operated as a quote-machine representing the Muslim community in Australia.

He was in court on Friday because of a disaster of his own making. After delivering a hostile tirade against Sydney's top-rated radio station, 2GB, during a ''peace'' rally in 2005, Trad was himself criticised the next day by a 2GB presenter, Jason Morrison, though not in the same language Trad had used at the rally where he claimed to speak on behalf of Muslims in Australia.

He read out parts of an article on homosexuals, submitting the views were "offensive" and showed Mr Trad to be a "disgraceful and dangerous individual".

Trad sued for defamation. He was the star witness for his own case. The senior judge, Justice Peter McClellan, the chief judge of common law in the NSW Supreme Court, found against Trad, and found him to be a witness of little credibility, a man of extreme views and, in summary, ''a disgraceful individual''.

Such was Trad's performance under oath that on Friday the counsel for the defence, Richard McHugh, SC, delivered this devastating portrayal of his credibility under oath: ''[Trad] attempted to evade responsibility for his statements by claiming he was misquoted, by claiming he was taken out of context, by claiming he had changed his mind, or by claiming he did not even know what he had said or written at the instant he said or wrote it. He was entirely disbelieved.

''[His] evidence that he did not know who was the author of Mein Kampf - and his feigned attempts at a thought process to recollect the author's name - were a low point in this trial. The transcript in this case can supply only a colourless picture of the evidence at trial.''

Even before this appeal, Trad was facing legal costs exceeding $250,000. He decided to up his risk. On Friday morning, I counted 16 lawyers in the court. At this level, justice is neither fast nor cheap.

His appeal was based on several major grounds but the most prominent and contentious, made repeatedly in oral and written submissions, was that Justice McClellan had erred fundamentally by taking Trad's provocative comments over the years out of the context of the Muslim community. To quote Evatt: ''His honour did not take into account that Australia is a multicultural society and the viewpoints of ethnic groups are recognised by the Australian community even though not all members of the community agree with them.''

And this: ''His honour did not refer to or even consider the likelihood the average citizen would recognise that the views expressed by [Trad] were similar to beliefs shared by Muslims throughout the world including Muslims in Australia.'' And this: ''His honour appears to have given no weight to the fact that the speech was made to Muslims in a mosque and not in an address to the general community.''

And this: ''His honour overlooked the fact Sheikh Hilaly's speech [defended by Trad] was not made to members of the Australian community but to Muslims and others who attended the Sidon Mosque in Lebanon.''

This is an explosive argument. It means this aspect of the appeal may rest on the argument that the Muslim community operates under different standards than the rest of society and cannot be judged using the same standards. Further, these standards, even if judged to be extreme by the rest of society, should be respected.

It is fair to say the bench became restive on Friday. There were plenty of tart exchanges from the three judges, justices Murray Tobias, Ruth McColl and John Basten. But this was nothing compared with the fire and brimstone from the defence.

This appeal was an attempt, McHugh argued, to turn the case into one about ''freedom of speech and freedom of religion, and that the appellant has been unfairly branded as a racist, homophobic, terrorist-supporting, woman-hating bigot when all he was doing was expressing views consistent with his Islamic faith and his role as a prominent Australian Lebanese community spokesman … The question here is whether the deliberate peddling of grossly sexist, homophobic, anti-Semitic filth is not dangerous and disgraceful and an incitement to violence and racist attitudes in Australia in 2010. The most extraordinary claim is that his extreme views are [a] 'Muslim view'. This ought not to be accepted.''

If Trad does prevail in his appeal, this case, Trad v Harbour Radio, will be corrosive to the idea of mainstream Muslim moderation, and to the ideal that most Muslims are naturally part of a cohesive element in the weave of Australia's culture rather than functioning under de facto Islamic law while giving mere lip service to the Australian legal system and the values it upholds.

Islam's man of a million comments

Recent events have focused attention on Muslims in a way never before considered. Deborah Cameron profiles one of the Sydney community's leading lights.

Pink pickled turnip and little sprigs of mint tumble out of the pita bread as Keysar Trad hits the kerb in his big old Pajero.

He is taking a short cut between his favourite falafel shop and a cafe where the walls are lined with jars of honey and bottles of rosewater.

The wheel thumps hard. The four-year-old in front lets out a squawk. His wife, Hanifeh, sitting in the back with the two-year-old, tut-tuts at him driving, eating, talking and winding down the windows, more or less at the same time.

Pulling up at the Farouk and Chehade El Bahsa Sweets shop in South Bankstown, everyone is ready for the ice-cream which comes in about 10 colours. It is practically an insult to order one scoop of pistachio. "You must taste every colour," insists Trad, handing over a deep silver bowl and spoon.

Outside it is warm. Hanifeh, covered from head to toe in a long dark-coloured dress and headscarf, looks cooler than she probably feels. For a woman of 38 with nine children, no money to spare and a husband devoted to voluntary community work, her face is free of worry. She is even at ease with what she calls "Keysar's pet topic": a second wife.

Trad is director of the Lebanese Muslim Association and, because the times have demanded it, an increasingly well-known community spokesman. He is a refugee advocate and translator, an essayist, a spokesman on political issues, a critic of racial labelling by police, a close adviser to the Mufti Sheik Taj el-Din Al Hilaly and a calm interpreter of Islam to the nervous broader community.

He gets frustrated with the association and has quit at least twice this year but returned out of a sense of duty and an instinct that it would revert to a "no comment" approach to the media which would be wrong at a time like this. Within his community he is criticised for publicly discussing refugees, Lebanese gang rapes and Islamic attitudes.

"They say when a Muslim speaks it is an admission that Islam has a problem," Trad says. "They say you don't see them filming churches when a Christian commits a rape or a murder, so why are you letting them come to interview you at the mosque? They don't realise that the media comes anyway. They tell me - just say "no comment" - but I have a million comments. They cannot censor me. I answer the questions sensibly and we have got nothing to hide."

TRAD and Hanifeh have been through a lot. They met in Lebanon when they were both about 22. They married after three weeks and she came to live with her new husband and mother-in-law in Yagoona. Trad worked at the Australian Tax Office while Hanifeh took English classes. "I find it hard to believe these mothers who cannot understand their children's language or who are dependent on their children for translation," she says.

Hanifeh, a law student in Lebanon, worked as an editor and journalist on Arabic publications in Sydney and studied computer science after emigrating. But when her fourth child was born, family took over.

It has not been easy and they remember 1998 as their worst year when Trad fell in love - "became obsessed", his wife says - with another woman. In desperation, Hanifeh proposed marriage on her husband's behalf to the other woman. "We were having a terrible time. He fell in love and I wasn't thinking about myself," she says. But his obsession passed. "He became more compassionate after it," Hanifeh says. "God meant for him to go through this experience and it made him a better person and more emotionally aware. It knocked him off his perch."

Hanifeh was not heartbroken. A second wife would have meant divorce (though he was against it) or living under the same roof as her husband's mistress. As long as the arrangement was fair and had the consent of all involved, it would be acceptable. Hanifeh loves her husband and the children, but says she is not strong enough, physically or emotionally, for more babies.

Aware that Australian law prohibits polygamy, they know a second wife could never be official. But their religion allows a man four wives and though a lot of what they say to each other about polygamy amounts to teasing, there is also a serious thread. It was Hanifeh who first raised it, approvingly, before they married.

Trad and Hanifeh say Islam is central to their values and the most important thing they can impart to their children. A strong set of beliefs is needed to resist society's temptations. Both were raised in large devout families - Trad the eldest son of his father's third wife, and Hanifeh a middle daughter in a family of 12 - and they have accepted the same model for themselves.

Trad arrived in Australia at 13 as part of a family reunion complicated by polygamy. His half-brother who had settled in Sydney got permission to bring his mother and siblings from Lebanon. Because his mother was married, she was able to bring her husband. At the time her husband was married to two other women. One of them (Trad's mother) came along, too, with her children. The older wife divorced her husband in Australia and the patriarch lived with Trad's mother.

To Trad's regret his father, in his 60s then, did not adjust. He could not find full-time work in Sydney. "Isn't it a shame for a grown man not to have a job," he would say, even as he neared death at 80. His father eventually returned to Lebanon which left Trad - as a teenager - responsible for his mother and the younger children.

After ice-cream, the family returns to the house Trad calls "the untidiest in street". In the lounge, three couches are pushed back against walls in need of painting. Bits of jute poke out of the plaster rubbed raw by chairs. A coffee table is laid with almonds, preserved green plums, sweet biscuits, glasses of cold delicious Lebanese cordial tasting like liquified quinces, and the baby capsule bearing the youngest child cooing and kicking his legs.

Trad is opening mail and wonders whether a letter from the council might be to direct him to mow the grass. Instead, it concerns the baby's immunisations. "Give this to your mum," he tells the four-year-old who has walked into the room prattling about The Simpsons and clutching a pencil case, two colouring books and an oven mitt.

In the same post is a statement from the Public Service superannuation fund. He reads out the balance which is tiny. "Money means nothing to me," he says. The family qualifies for low-income support. Trad is prepared for more years of financial hardship.

For the children, it means few toys and a scant wardrobe. "I can see when my son needs new pants but he doesn't talk about it," Hanifeh says. "The kids don't ask for too much." Hanifeh reads the employment section on his behalf, but one of the children put it well: "Dad doesn't need a job; he needs a miracle to make him rich."

The mayhem that comes with nine children in a modest house does not faze them. Even on a school day with six of the kids at local public high and primary schools, the three youngest are a distraction. Conversation occurs against a background of slamming doors, kids yelling and toys being dropped, with neither parent worried. They wipe runny noses and finish complicated anecdotes.

"Imagine if our children grow up with good values like we are trying to give them,"says Trad, "Imagine what great people they'll be for society. I have to make sure that they are positive, contributing members. I will be happy if their sense of social justice is very strong."

Trad's faith has had its phases. It was least strong in Lebanon when he lived among non-practising Muslims who rarely prayed at mosques and did not have access to religious texts. Arriving in Australia he was advised by his half-brother to keep quiet about religion, to be careful around women and to change his name. His half-brother went by the surname Wilson.

For the first few years Trad did not talk about his religion. "People could see that my mother covered her hair; they knew that I was Muslim but I couldn't talk about it because I didn't know where to begin," Trad says.

He was gradually drawn in, especially after a 1987 pilgrimage to Mecca with his mother that he regards as his spiritual turning point. After that he prayed five times a day on schedule, even at the office.

"I was adamant that if someone could take a five-minute break for a ciggie, I could sit at my workstation and pray for five minutes," Trad said. "I was on good terms with my boss and she said it was OK. Initially people made jokes about me headbutting my head against the carpet or by flicking rubber bands while I was praying. But they were my close friends so it didn't matter. It was nothing."

Trad resigned from the ATO at the end of 1998, the year of his infatuation. It was a decision with some familiar elements for anyone who has had a mid-life crisis or considered a sea change. A decade after his Mecca visit he wanted to do religious work. He travelled with his family to Lebanon for three months and returned home to write.

Known at the Lakemba Mosque as a translator, the Mufti asked him to take a more prominent role. Trad is a natural communicator in a community that is not blessed with them and, with his Public Service background, knows the limits in political debate. (When an Iraqi acquaintance once made a colourful reference to Jews, Trad ticked him off.) Instead of being suspicious and defensive with talkback callers, politicians and journalists, he is prepared to explain.

The Public Service also made him confront some of his practices - he cropped his beard and, after a debate with himself, started shaking hands with women. "I kept saying, 'Please don't be offended' but a couple of them were honest and said that they were offended. And I thought - do I really have to be so strict?"

Schools hit by class war - Coalition objects to 'Labor' lessons

SENIOR school students will be taught about the formation of the Labor Party and union movement but little about the struggles of the conservative side of politics.

Sparking a fresh political brawl, thousands of high school history students will also be asked to examine minutes from union meetings so they can better appreciate a "worker" perspective.

The controversial education strategy forms part of a draft national course - The Development of Australian Identity - to be rolled out from next year.

It has triggered a backlash, with the Federal Opposition claiming students would get "a skewed view of history".

"The drafters of the national curriculum seem to think that the only side of political history worth studying is the history of the union movement and the birth of the Labor Party," Coalition education spokesman Christopher Pyne said.

The Australian Curriculum Assessment and Reporting Authority (ACARA) has previously been in hot water for teaching students how to apply for welfare benefits as part of the maths curriculum.

It has given teachers and the public until the end of July to comment on its draft national curriculum. This would then be rolled out next year, providing a uniform curriculum for the first time in Australia.

Releasing the draft in May, Deputy Prime Minister Julia Gillard said the education plan was "important to our sense of being one nation".

Last night, Ms Gillard accused the Coalition and Mr Pyne of being "all talk and no action" on a national curriculum.

"Now, instead of being constructive, he is of course simply being negative but worst of all, he is wrong," Ms Gillard said.

"The draft history curriculum does include elements of the conservative side of politics. The section Mr Pyne refers to, which of course is an optional unit, covers a period of history before the Liberal Party existed, so it is hardly surprising it isn't mentioned."

Ms Gillard said the education experts at ACARA had released the curriculum as a draft "and Mr Pyne, like every other Australian, was encouraged to have their say on the final".

The Coalition claimed the ACARA drafts were forcing a view of politics on to students.

"They believe the union movement and the Labor Party is the only side of politics that should be studied," Mr Pyne said.
