ABC won't tell the full story of slush funds

EXPECT astonishment from the ABC's vast national audience when the federal government places trade-union slush funds front-and-centre of a major inquiry in the New Year.

The rusted-on viewers and listeners will be bewildered because the taxpayer-funded state-owned broadcaster has imposed a regimen of strict censorship on the key element in the inquiry - the misuse of money from the AWU association which was established with the assistance of legal advice from former Prime Minister Julia Gillard when she was a partner in the Victorian Labor law firm Slater & Gordon.

Those who don't take their news solely from the ABC would be well aware that the Victorian police are conducting a major inquiry into Ms Gillard's role in the establishment of the Australian Workers' Union Workplace Reform Association by her then boyfriend, Bruce Wilson and his AWU mate Ralph Blewitt in 1992.

Early last week, The Australian newspaper revealed that Fair Work Commissioner and former AWU boss Ian Cambridge has given sworn evidence of "gross irregularities" in the union slush fund that Ms Gillard advised on.

The Gillard Files

Wilson, who was in a long-term relationship with Ms Gillard in the 1990s is the target of a police investigation and Victorian fraud squad detectives have already seized files from Slater & Gordon, files which Wilson claims should be subject to client-lawyer privilege.

The detectives are seeking to establish whether the documents were created in furtherance of a fraud, which would render void the privilege claim and make them available as evidence.

The court heard Mr Cambridge had provided "substantial evidence" in his affidavit about misappropriation of union funds by Ms Gillard.

Lawyer Ron Gipp, representing lead fraud squad detective Ross Mitchell, said Mr Cambridge's evidence "puts it beyond any doubt" that there were "gross irregularities" in the funding of the association, which Ms Gillard referred to as a "slush fund" in an exit interview before she left Slater & Gordon.

He said statements from Mr Blewitt - "essentially a full confession by a co-accused" - describe the slush fund as a "scam".

Ms Gillard has repeatedly denied wrongdoing and said she had no knowledge of the fund's operations other than it was a "slush fund" for the re-election of union officials.

Money from the fund was used to purchase the Fitzroy house in Mr Blewitt's name at a 1993 auction, which Ms Gillard attended with Mr Wilson, who subsequently lived in the property.

Slater & Gordon handled the conveyancing and helped provide finance.

That's the background for ABC fans who have been kept in the dark and goes someway to explaining why many other Australians not affected by the ABC's news blackout are watching every legal move in this case.

In her exit interview with Slater & Gordon on September 1, 1995, Ms Gillard said: "It's common practice, indeed every union has what it refers to as a re-election fund, slush fund".

Whether every union does indeed have a slush fund is something the federal government should be looking into, and probably will, informed as it is by the material being developed by the ongoing AWU investigation.

Even without an official inquiry, it has emerged that money was used from a union slush fund known as the McLean Forum to finance campaigns in internal elections in the TWU's Queensland branch and to bankroll candidates in the Flight Attendants Association of Australia and the Health Services Union's NSW Branch.

Sums of at least $500,000 were reportedly spent in the TWU's Queensland campaign.

It was reported in March that a fund known as Industry 2020 donated funds for HSU elections and a 2008 article in The Sydney Morning Herald noted that former Prime Minister Julia Gillard "was a guest speaker at the inaugural fundraising lunch for the Industry 2020 fund at Flemington racecourse, which generated about $250,000 with nearly half that profit".

In that article it was also suggested that "two other fundraisers have been held for Industry 2020, including a small event at Melbourne's Greek Museum in Melbourne last year attended by (current Opposition leader) Mr (Bill) Shorten".

The Age reported in May that ASIC records in May showed that Industry 2020 was a registered company under Mr Cesar Melhem's sole directorship. Mr Melhem was formerly the AWU Victorian Secretary but is now a Victorian Labor MP, a more recent search however indicated that two companies, Industry 2020 Pty Ltd and Industry 2020 Ltd are both under voluntary external administration.

Two weeks ago, The Age reported that the nation's largest construction union, the CFMEU, had used a drug and alcohol charity to raise up to $1 million for union activities.

It has also been revealed that the Queensland branch of the Shop, Distributive and Allied Union has for a decade had an undisclosed internal slush fund - wrongly promoted to contributors as being tax deductible - to support union boss, Mr Chris Ketter's, re-election as State Secretary of the union. Mr Ketter was the ALP's lead Senate candidate in Queensland at the 2013 election.

The ongoing court case against former Labor MP and former HSU boss Craig Thomson over his alleged misuse of trade union funds has given added impetus to the need for a wider investigation into trade unions and their handling of members' funds.

The establishment of slush funds, the practice Ms Gillard regards as "common place" and carried out by "every union" must be examined to ensure that such operations are held to the same exacting standards of governance as organisations which hold investors' money.

Trade union members deserve to know who is responsible for holding their compulsory contributions and how their cash is being spent.

For too long, the union bosses have insisted that the Labor Party turn a blind eye to union activities.

Next year, the ALP must be given the opportunity to demonstrate it truly has the workers' interests at heart.

It will send a disgraceful message if it doesn't champion the broadest inquiry into the operation of slush funds and the union movement's handling of members' money more generally.

Surely it has nothing to hide?

SPEAKING to troops in Townsville, Kevin Rudd told his own war story about how he too had gone outside "the wire" into the danger zone in Afghanistan.

Casting himself as a Prime Minister who had ventured beyond safe Australian bases in the war-torn country, he said he had "gone out" into the field once or twice.




Mr Rudd made the remarks after thanking 100 soldiers at Lavarack Barracks for their service to Australia and he promised to do more to help their comrades who struggle to return to civilian life.

Many raised their hands when he asked who had served in Afghanistan.

He urged them to visit the War Memorial in Canberra to see the latest exhibition on the Afghanistan War, which has claimed 40 Australians, including four who were based at Townsville, and shared his own experience of the conflict.

"If you get down to Canberra have a look at the new exhibit on Afghanistan," he said.

"The War Memorial has got the best piece of what I would describe as live action film of what it is like to be in the field in Afghanistan ... right at the point of engagement with the enemy.

"I was just taken aback, I have been to Tarin Kowt many times, probably five or six times now, and I have been basically behind the wire, once or twice I have gone out."

He said the exhibition "reminds us that this was not the odd angry shot - Afghanistan - this is a real, hard-fought war on the ground."

Mr Rudd's spokeswoman said he had ventured outside an Australian base during a three-day visit as Foreign Minister in March 2011.

The spokeswoman said Mr Rudd, who visited an Australian base with his wife Therese Rein last month, saw the work of troops during the time in the field.

After a tour of the Townsville on Tuesday in which he inspected a camouflage exercise and two Light Weight Howitzer gunners, he asked the soldiers to gather so he could thank them for their bravery.

"For all of you here and through to your comrades still in Afghanistan, another reason for coming here today is just to say thank you for the work that you and the Australian Defence Force have done in all of our name in Afghanistan," he said.

"As you know, in Afghanistan, 40 of our best and bravest have not come home, 250-odd have been wounded."

Referring to Private Benjamin Ranaudo, Private Matthew Lambert, Captain Bryce Duffy and Lance Corporal Luke Gavin, he said: "And you've lost four or five here from this very base at Lavarack and we remember them today as well."

Mr Rudd made the visit after campaigning at a nearby childcare centre in the LNP-held seat of Herbert, which is on a 2.2 per cent margin, where he pledged $30.6 million to train more childcare, disability support and aged care workers.

AUSTRALIA has taken a lead role in Syria's humanitarian crisis amid warnings that if not resolved within months, the world would have to deal with the greatest exodus of refugees since World War II.




Foreign Minister Bob Carr last night took an emergency aid plan to a meeting of European foreign leaders and the Arab League which said Australia would immediately boost its medical and food aid by $24 million for the two million people so far forced from their homes.

Mr Carr said Australia would also offer to help rebuild a future democratic government in the war-torn Middle Eastern country, but demanded terrorist groups such as al-Qaeda played no role in ruling the country.

The country's chemical weapons would also have to be secured so they did not fall into the hands of terrorists.

Australia would not be spared the ultimate knock-on effects of millions of refugees if the regime of Bashar al-Assad was not removed.

"The Syrian war is one of the world's great humanitarian disasters," Mr Carr said. "It has been described as risking the greatest refugee crisis since World War II."

KEVIN Rudd is continuing his charm offensive as senior Gillard Government ministers insist the government is not in crisis.

The former PM, who earlier this week appeared on morning show Sunrise and with a chainsaw helping flood victims in Queensland with their clean-up, today tweeted about the joys of his new granddaughter.

It was accompanied with a picture of a relaxed Mr Rudd reclining on the lounge with his daughter Jessica's new baby, a rattle, and a soft toy.

  • September 8, 2011 - NSW police drop their investigation into allegations Mr Thomson misused a union credit card, saying they had no evidence.
  • September 22 - Mr Williamson is suspended on full pay as HSU national president following allegations he embezzled union funds. Chris Brown is appointed acting national president a few days later.
  • November, 2011 - A motion of no confidence against Ms Jackson as HSU executive president is passed at the union's annual conference. Ms Jackson vows to stay as head of the union until end of 2014.
  • March 14, 2012 - FWA's investigation into HSU Victoria No 1 branch is completed. Three former officials are said to face Federal Court action.
  • April 3, 2012 - FWA says its investigations are complete. 
  • April 5 - The ACTU suspends the HSU until the union can resolve its governance and financial management issues.
  • April 8 - Pressure mounts for Mr Williamson to be sacked from Unions NSW.

  • April 13 - Infighting within the HSU intensifies, with Ms Jackson charging Mr Williamson under the HSU's rules in a bid to have him removed.

  • June 6 - Former prostitute who claimed in an interview with A Current Affair to have slept with Mr Thomson recants and apologises, claiming a case of "complete mistaken identity".
  • October 15 - Fair Work Australia takes Federal Court action alleging Mr Thomson misused hundreds of thousands of dollars in union funds.
  • October 24 - Fraud squads from NSW and Victoria raid Craig Thomson's house, seizing computers and other items.
  • December 4 - Mr Thomson formally denies spending union money on prostitutes and improperly using his position as Health Services Union national secretary in a 28-page defence lodged in the Federal Court.
  • January 31, 2013 - Mr Thomson is arrested at his electorate office on the NSW Central Coast and is due to face court in Victoria on 150 counts of fraud, which his lawyer says he denies.

Closing on the truth as Obeids take the stand

D-DAY has finally arrived for the Obeid family.

As the state's most explosive ICAC inquiry nears the finish line, today it zeroes in on its targets- with Eddie Obeid and his son Moses due to take the stand.

The hearing has been told of corruption at a level allegedly unseen since the days of the Rum Corps. This morning will see the start of the Obeid corps, with seven relatives to give evidence in coming days.

The former MP's wife Judith was announced as a last-minute addition to today's witness list but it is Moses, her eldest son, who is expected to step into the box first for a grilling over the family's involvement in a multi-million dollar mining venture.

Mr Obeid's four other sons- referred to at the inquiry as "the boys" - will give evidence tomorrow





WEALTHY businessman John McGuigan dropped his head in his hands. He faced up to one of the most embarrassing moments.
Former minister Ian Macdonald allegedly gave the Obeids inside information potentially worth $100 million and rigged the tender process for a coal mining exploration licence in the Bylong Valley.

Mr Macdonald will give evidence next month.

Yesterday, secretly taped phone calls between the major players in the successful bidder Cascade Coal revealed a belief "the shortest distance to a pot of money" was a proposed $500 million takeover to be made after the Obeid family were bought out of the venture. ICAC was played a colourful late night call between Greg Jones, a close friend of Mr Macdonald, and businessman John McGuigan.

The March 2011 call was peppered with expletives and insults directed at Graham Cubbin, a non-executive director at White Energy, the company on the verge of the takeover. Mr McGuigan is heard describing his "discussion with the [Obeid] boys" where he reassured them "this is not some ... Machiavellian play to ... f ... you guys around."

The inquiry heard Cascade Coal wanted the Obeids out of their 25 per cent venture because of the poor association the family's name carried in business, with Mr McGuigan describing their reputation as "an aroma".

Mr Cubbin was considered a thorn in their side by Cascade Coal because of his persistent questions about the Obeid role in the deal, ICAC heard.

"This prick Cubbin who is going ... to have his nuts on the f ..... quartermast," Mr McGuigan is heard to say.

"What I've been thinking is ... how do we get control, how do we manage reputation and what's the shortest distance to a pot of money."

Watching Mr McGuigan give evidence yesterday was a surprise court watcher - former Kings Cross underworld figure and convicted drug dealer Bill Bayeh.

Bayeh, still on parole for dealing in cocaine and heroin from a Double Bay cafe, would not tell The Daily Telegraph who he was there to support.

IN February 1983, just weeks before the first Hawke ministry was sworn in, ASIO believed that the new minister for veterans' affairs, Arthur Gietzelt, was possibly "a secret member" of the Communist Party and "under some form of control" by the Soviet Union.

Several months after senator Gietzelt became a minister, an ASIO agent reported in a "secret" note a conversation between Communist Party leaders Laurie Aarons and Joe Palmada that revealed senator Gietzelt was "still a financial member of the CPA" and that he was meeting Aarons "regularly".

A previously unreleased cache of ASIO files made available to The Australian provides the first documentary evidence that Mr Gietzelt, now 92, was believed to have still had close links with the Communist Party while serving as a minister.

A "secret" ASIO minute paper, dated February 18, 1983, concluded with the "possibility" that "GIETZELT is under some form of control by the Soviets. As a secret member of the CPA and a parliamentarian he would undoubtedly be of interest to the Soviets," it said.

In an interview with The Australian, former prime minister Bob Hawke said: "I just don't think it is appropriate for a (former) prime minister to discuss the nature of the conversations they had with ASIO."

Mr Hawke said he was satisfied about senator Gietzelt's loyalty to the government.

"I had no problem with any of my ministers in terms of their complete commitment to the Australian Labor Party," he said.

"I had heard there was scuttlebutt about Gietzelt; there was scuttlebutt about Tom Uren. But as far as I was concerned they were totally committed to the Labor Party."

ASIO maintained its interest in senator Gietzelt's alleged communist linkages as the Hawke government came into office and while senator Gietzelt was serving as a minister.

Two days before the March 5, 1983 election, which swept Labor into government, ASIO completed an examination of its extensive files on senator Gietzelt, who had been a member of the upper house since 1971. "An examination of the GIETZELT file leads to the conclusion that he was and probably remains a secret member of the Communist Party of Australia," notes a minute paper labelled "top secret".

Another "secret" file note prepared in April 1982, during the Fraser government, documents senator Gietzelt's association with the Communist Party between April 1976 and November 1981.

It reports that Aarons, the then national secretary of the Communist Party, described senator Gietzelt as "the CPA's official parliamentary co-ordinator in Canberra between 1972 and 1975" -- the term of Gough Whitlam's Labor government.

It also notes that senator Gietzelt "was a secret member of the CPA" in 1969 or 1970, and also in 1979 that he "is a dual ticket holder (CPA/ALP) and is the main key of influence of the CPA in the left wing of the ALP".

In the March 1983 document, ASIO notes that while the source material on senator Gietzelt's secret involvement in the Communist Party stretched for at least four decades, it could not be certain that he "was a secret party member", even though earlier and later ASIO documents suggest that he was.

ASIO's files cover his alleged involvement with the Communist Party from the 1940s to at least the 1980s, and include extensive agent reports, informant reports, photos and films outlining a secret role in organising for the CPA inside the Labor Party.

Several ASIO files concerning senator Gietzelt's Communist Party linkages remain unreleased. Several documents that have been released have many redactions throughout.

When contacted by The Australian on Monday, Mr Gietzelt refused to respond to the ASIO claims in the new documents. When contacted by The Australian in 2010, Mr Gietzelt denied that he was a member of, or an organiser for, the Communist Party.

ASYLUM seekers in Indonesia have swung into party mode and labelled Julia Gillard a "hero" after learning they will receive welfare payments and rent assistance should they make it to Australia by boat.

The wannabe citizens are ecstatic the government has conceded detention centres are beyond maximum capacity and that asylum seekers would need to be released into the community while their applications for refugee status were processed.

They would be given financial and housing support - as well as free basic health care - a massive boost from their current financial status in Indonesia where many are struggling to afford food.

However the asylum seekers, based in Puncak, 80km from Jakarta, said they feared Liberal leader Tony Abbott would be successful in his bid to become prime minister.

"Mr Abbott is not good for refugees and asylum seekers, he does not like us, he is not really a nice man," said Zia Haidari, a 25-year-old Afghanistan man who has attempted - unsuccessfully - to travel to Australia by boat seven times.

"Ms Gillard seems to understand how we feel and is trying her best.


Socialist Priorities Down Under Grant Lee is not one of them.


"Abdulah Sulamani, 41, heaped praise on Ms Gillard: "She is a hero, you are lucky to have this woman for your country."


Solo mother Fatemeh Khavari, 30, told News Ltd she did not have enough money saved to travel by boat to Australia and had spent time living homeless and hungry in Indonesia with her six-month-old son.

Labor's announcement was music to her ears.

"If I can get this free money and house when I come to Australia this will make life very easy for me," Ms Khavari said.

"It is very hard right now for us, I cannot afford to buy milk formula, we are very hungry. Me and my child need the generosity of the Australian people.

"If that doesn't happen my baby may die."

Ms Khavari - whose reasons fleeing Iran were "private" - said the other factor to draw her towards Australia was free medical care.

"I cannot afford to have vaccinations for my baby so I can get this in Australia.

A new monthly record was set in November with 2443 people arriving on boats and Ms Gillard was asked yesterday if she would bring back temporary protection visas and tow boats back to Indonesia.

The government last month announced thousands of asylum seekers threatened with processing in Nauru and Manus Island would be released in the community in Australia on bridging visas with almost $440 a fortnight plus help to pay rent.

It is understood the government is aware large numbers of asylum seekers are rushing to get on boats in Indonesia before the monsoon season and are undeterred by the government's pledge to keep them waiting in the community for protection visas for up to five years under a "no advantage" test.

Ms Gillard said TPVs and tow backs were not policy options hours before the government announced 75 people on two boats had been rescued by the Navy off Christmas Island.

"This is a complicated issue for our nation, for nations around the world," Ms Gillard told Channel 10.

"Anybody who says that there is a simple fix to you is not telling you the truth. It takes a range of policies, and we are putting that range of policies in place."

The desperation in the voices of asylum seekers in Puncak is echoed right throughout the village, where many asylum seekers come prior to embarking on the sea journey to Australia.

They eat their basic evening meals with rusty utensils scattered around. Their tiny bedrooms contain no blankets and sleep up to eight people. The days are dull with no ability to work as work visas from Indonesian officials are non-existent for the travellers.

It is this harsh reality of life in villages like Punchak combined with the arrival of news about Labor's policy backflip that is bringing about party fever and the desire to come to Australia as soon as possible.

Seventeen-year-old Adres, who does not have a surname listed on his passport, said when he arrived on Indonesian soil three weeks ago he planned to apply for refugee status through UNHCR.

But upon learning of the over-filled detention centres in Australia he was determined to travel by sea.

"This is good news for us, if we stay here and apply for status we might not be allowed into Australia, but if we come on boat we get the money and house," Adres said.

"This is a great thing and I am very thanking to the government in your country."

The Afghanistan teenager, whose father was killed in Pakistan, made the journey to Indonesia by plane. He saved for the journey and would use his money to engage people smugglers.

"It is a dangerous risk but worth it to get a new country with opportunities.

"This is party time."

Gillard's old friends dig up the dirt

ONE way or another everybody ends up paying for their mistakes. The bigger the mistake, the bigger the price, bigger still if the doer holds high office.

Julia Gillard has made a few doozies in her life and she is paying for them now. Call it karma, call it retribution, call it plain old revenge, Gillard is suffering from events of 17 years ago, and not only because, as Nicola Roxon observed, she might have had bad taste in men. You think?



Even if, as Gillard says, she did nothing wrong when she was a partner in law firm Slater & Gordon, what happened then was not trivial and nor is it now inconsequential, no matter how hard she and her supporters try to make it so.

The excuses made on her behalf are as numerous as those she makes for herself. They run along these lines: nothing has emerged to prove she has done anything wrong, it was so long ago it is irrelevant today, no smoking gun has been produced, no documents have surfaced to contradict her accounts, plus her accusers are either shonky, they have an axe to grind, they are desperate for distractions, they are throwing mud, they are throwing old mud or they are misogynist nut jobs and sexist pigs.

Gillard's frustration is palpable, her fury barely disguised in the face of these attacks on her honesty and her character. You could see it in parliament and at her press conference. In parliament it was a toss-up what she found the most galling: the fact that Julie Bishop was daring to question her, or that Tony Abbott refused for two days to question her at all about that issue.

Sensibly, Abbott stayed out of it, lashed like Ulysses to his chair in the house, resisting the calls of the sirens, knowing if he responded he risked terminal injuries. As one of his advisers said: "When all your enemies are pressuring you to do something, then clearly it is not a good idea to do it."

It suits Gillard to present the campaign against her as some vast right-wing conspiracy; however, she knows only too well the roots of this story lie deeply embedded in the Labor movement.

One Labor MP, a supporter of Gillard, neatly summed up by blaming a "rat-infested AWU for her political persecution".

Abbott's strategic withdrawal also sensibly ended with Gillard's decision to jump before she was rolled by her own backbenchers over the UN vote to grant observer status to Palestine. The leaking of that story so quickly and so comprehensively, especially the detail of the cabinet debate where she overruled her ministers to insist on a no vote was an ominous sign for Gillard.

Another ominous sign was Bob Carr opposing her in cabinet then threatening to speak against her in caucus, which would have resulted in her losing both the vote and her foreign minister.

Finally the gravity of her situation sunk in.

After amputating her legs, Carr sped out to praise her support for the abstention he had compelled her to adopt as a display of clever leadership. There's a Yiddish word for that: chutzpah. In English, it's give us a break.

If Gillard had not been so preoccupied by the AWU scandal, she would have seen it coming. If she had been properly plugged in to her caucus she would have known the numbers were not there. Then again her capacity to read people and judge situations has always been suspect.

At Monday's press conference she was defiant and belligerent, complaining about the recycling and re-recycling of old fabrications, daring journalists to choose between her and self-confessed fraudster Ralph Blewitt, without once saying he was present when she signed his power of attorney.

She seized on the contribution of one of the crooners, that band of sympathetic male journalists, to thank him and echo his question by asking: "what is the big deal?" Try this: she was the instrument used by her then boyfriend, AWU official Bruce Wilson, to help set up the instrument that enabled the defrauding of hundreds of thousands of dollars that today remains missing. Owners of the Fitzroy property shouldn't waste time fossicking in the backyard.

For some people hundreds of thousands of dollars isn't a big deal. For others it is. It reminds them of other big deals such as the one that got Michael Williamson into so much trouble, the same one that wrecked Craig Thomson's career, or the ones Eddie Obeid is accused of which are stinking out the NSW Labor Party.

For too long people inside the Labor movement failed to acknowledge big deals even when they rose up and bit them on the bum. If you are looking for reasons for record low membership, add this to the list.

Just for fun, how's this for another big deal: Gillard accuses the opposition of wallowing in sleaze, yet she spent four years surrounded by it and was, by her own admission, oblivious to it.

Her boyfriend's bestie all that time was Blewitt, who has gone from bagman to bogeyman to criminal genius. Blewitt says Wilson was the mastermind, Wilson insists it was Blewitt and that he was burying stolen money in the backyard. Dontcha love it when thieves fall out.

Echoes reverberated on the ABC's 7.30 when Wilson said he could not see what the big deal was, nor understand why this story kept getting recycled and recycled. Perhaps it's partly because its taken 17 years for Blewitt and Wilson to talk publicly about it.

Blewitt is the same bestie Gillard now describes as an imbecilic sexist pig and crook, who was joined at the hip with her then boyfriend. It is the same Blewitt the government reckons is a "scumbag" and that Bishop's contact with him in pursuit of information against the Prime Minister warrants her sacking because it showed her lack of judgment.

Bishop's meeting with Blewitt was dumb and her loose words garnered the kind of prominent coverage denied to the original questions to the Prime Minister over her role, but hey, if you follow the government's arguments of guilt by association to its logical conclusion, where does it lead you with the Prime Minister?

Gillard, showing way too much hubris and way too little self-awareness, picked up on the theme in parliament to get stuck into the opposition for its lack of standards "and the company they keep".

Gillard's prime ministership has turned into a cross between Judge Judy ("they done me wrong your honour") and CSI (join the dots, find the culprits).

She is ending the parliamentary year as she began it. Very badly. Her enemies inside and outside, in front of her and behind her, will not give up, confident any poll improvement is ephemeral.

According to one Ruddite, the AWU scandal isn't killing her, not yet, and it won't unless something else emerges, but it is hurting her. A lot. All because of that pesky question of trust, which hangs like a shroud over almost everything she says and does.
