A GIRL who was allegedly the victim of female genital mutilation told authorities she was told to close her eyes and imagine she was a princess in a garden when she was allegedly cut.



“She told me to think of that so I didn’t feel as much but I did feel it a little bit ... it hurt,” the girl, aged 8, said in a recorded interview with a police officer and a social worker at her primary school.

The interview, recorded on August 29, 2012, was played to a jury today at the first trial for female genital mutilation in NSW.

On trial are the girls’ mother, 38, along with a retired midwife, 71, and a high-ranking Sheik from the Shia Islamic sect Dawoodi Bohra.

The mother and the midwife, known only as A2 and KM to protect the identities of the girls, have pleaded not guilty to two counts of female genital mutilation which carries a maximum penalty of 21 years.

The religious leader, Sheik Shabbir Mohammedbhai Vaziri, 59, has pleaded not guilty to being an accessory after the fact to female genital mutilation.

In the interview, the social worker asked the girl, known as C1, if she knew about the Dawoodi Bohra procedure of khatna where a girls private parts are cut.

“Yes,” she said. “It is because it has happened to me.”

C1 went on to describe how khatna was performed on her when she was seven by an unknown woman in a Wollongong house while her mother, grandmother and her great aunt stood by.

She told the social worker and a police officer that in her culture, “it has to happen to every girl, it has to be at seven, I think it has to be.”

C1 said she next met the woman when the same procedure was carried out on her six-year-old sister at their family home in Sydney during the school holidays in 2012.

The Crown alleges the mother arranged for the midwife to carry out the procedures on her daughters which is believed to have taken place in October 2009 and July 2012.

In his opening to the jury, barrister for KM Stuart Bouveng told the jury that she only touched the girls with forceps for a few seconds during the procedure.

He said a medical examination of the girls at The Children’s Hospital at Westmead showed there was “no evidence of scarring,” and the genital tissue looked “normal.”

The Crown alleged that when police began investigating the practice of female genital mutilation among the Dawoodi Bohra Sheik Vaziri told people to tell say they do not believe in the practice.

The Dawoodi Bohra are a Shia Islamic sect with about a million followers worldwide who mostly live in western India and Pakistan.

C1 and her sister C2, now aged 11 and nine, will give evidence on Wednesday.

AUTHORITIES will crack down on forced marriages, female genital mutilation and the abuse of migrant spouses under a new national plan to stop violence against women.

Prime Minister Tony Abbott will today launch the $100 million Second Action Plan to stop domestic violence, which will also see state and territory governments commit to work on implementing a national scheme for domestic violence orders.

The scheme means perpetrators of domestic abuse would no longer be able to flee across state borders to escape court sanctions, and women who move interstate would still be protected from violent partners.

The plan is the second phase of a 12-year strategy to curb violence against women and their children.

Currently one in three Australian women experience physical violence, and domestic abuse will cost the national economy more than $15.5 billion a year by 2021 unless stronger action is taken.

“As a husband, a father and as a brother, I believe it is the responsibility for all of us to stand against domestic and family violence,” Mr Abbott told News Corp.

“The Second Action Plan is about improving what we already do in terms of prevention, action and support. It contains practical actions that are critical to improve women’s safety.”

The plan will specifically target abuse perpetrated against women with a disability, women from culturally diverse backgrounds, and Indigenous women who are 31 times more likely to be hospitalised due to family violence related assaults.

The plan will mean foreign-born spouses who come to Australia on marriage visas will receive additional support. Their husbands or fiancés will have to provide authorities with additional information, and new material will be developed to inform these women about essential services and emergency contacts in Australia.

“We must be aware that sadly, some women coming to our country are not afforded the same rights at home and we must as a Government ensure they are equipped with the knowledge they need to prevent being subjected to violence and abuse,” Senator Cash said.

The long-awaited plan will also commit states and territories to work with the Commonwealth to streamline information sharing and establish national standards for perpetrator intervention.

It says it is “highly desirable” that state-based domestic violence orders be nationalised.

Northern Territory Minister Bess Price, who will attend today’s launch, said she is pleased the Second Action Plan has specific initiatives to deal with violence against Indigenous women.

“I have been a victim as well, and I know how it is, and I want to make sure the future is better for women and their families and that help is provided so women can feel safe.”

Father in court charged with organising infant daughter's circumcision

A MAN who has been charged with organising the female circumcision of his nine-month-old daughter in Indonesia almost two years ago faced Manly Local Court today.



The man, 29, who recently relocated from NSW to Victoria with his family, cannot be identified for legal reasons.

Manly Local Court Magistrate William Brydon granted the suppression order, which forbids the publication of the names of the accused, his wife and the victim.

According to documents tendered to the court, police allege the accused took his infant daughter to Jakarta, Indonesia in 2012 so she could undergo female circumcision, wihch is known in the west as genital mutilation.

NSW Police were alerted to the incident after the child's mother took her to a doctor about six months later.

Following investigations, an officer from the Sex Crimes Command, Detective Kelly Barby arrested the accused at 11am on 31 December 2013.

He was charged later that day at Dee Why Police Station.

The man is yet to enter a plea and will remain on bail until he appears in Downing Centre Local Court on March 25.

A man has been arrested and charged in relation to the alleged female genital mutilation of an infant.

Officers from the Child Abuse Squad have been told that while holidaying overseas in February 2012 the man 

allegedly organised for his daughter, who was then nine-months-old, to undergo a procedure known as female circumcision.

NSW Police were alerted to the incident after the child’s mother took her to a doctor about six months later.

Following investigations, police arrested a man yesterday (Tuesday 31 December 2013). 

He was subsequently charged with aid/abet/counsel or procure female genital mutilation.

The man was granted conditional bail and will appear in Manly Local Court on Tuesday 28 January 2014.

A LAWYER involved in an alleged female genital mutilation case will face court today charged with two counts of perverting the course of justice.

Detectives from the Sex Crimes Squad and attached to Strike Force Longfield arrested the solicitor at his office in Sydney's inner west.

The strike force was set up to investigation claims two young girls had the procedure, also known as female circumcision, performed on them when they were aged six and seven.

Eight people remain before the court after being arrested by detectives last year. Findings are yet to be handed down in those cases

The lawyer has been charged with two counts of do act with intent to pervert the course of justice. He was granted conditional bail and will appear at Parramatta Local Court next week.

A SYDNEY sheik accused of involvement in the barbaric "genital circumcision" of sisters aged 6 and 7 is alleged to have told his Muslim community to lie about its widespread practice.

Police claim Sheik Shabbir Mohammedbhai Vaziri told members of the Dawoodi Bohra community at Auburn to lie to police when they questioned them over the mutilations.

Vaziri, 56, of Auburn, Helen Magennis, 68, a retired nurse of Campbelltown, and the children's parents have all been charged in relation to the alleged acts on the girls.

Police allege the procedures were carried out by Magennis.

A strike force of seven detectives from the NSW sex crimes unit was set up after an anonymous tip to the Department of Community Services several months ago.

It is the first time anyone has been charged with the offence in relation to children after legislation was passed in 1994.

A MAN has appeared in a Sydney court charged over the genital mutilation of two girls aged six and seven.

Family and Community Services Minister Pru Goward said she did not believe genital mutilation was rare in NSW.

Ms Goward said that female genital mutilation was an "abhorrent practice" and "a form of child abuse".

The two children are still in the care of their parents.

"They are good parents," NSW sex crimes unit head Detective Superintendent John Kerlatic said.

"It may seem a contradiction to say that when the parents are facing such serious charges. But they are not in any danger of any physical abuse."

The alleged genital mutilations occurred in the past 18 months at homes in Sydney.

Vaziri appeared in Burwood court yesterday on two counts of being an accessory after the fact to female genital mutilation, and hindering the police investigation.

Police allege Vaziri hindered the investigation by telling people to lie about the extent of female genital mutilation.

Magistrate Chris Longley said despite what many people would see as very serious charges, he was granting bail under strict conditions.

He said police opposed bail saying Vaziri was a flight risk.

Mr Longley ordered Vaziri surrender his passport and report to Auburn police daily and appear in Parramatta Local Court on September 26.

The parents were charged last Friday, granted bail and ordered to reappear in court on September 26.

Magennis is alleged to have carried out the procedure and was granted bail to reappear on October 3.

THOUSANDS of victims of genital mutilation live in NSW and experts say doctors are untrained in how to treat them, with many suffering from childbirth complications as a result of their condition.

With an increased intake of refugees from countries in Africa, the Middle East and south-east Asia, more women with genital mutilation are living in Australia, with most in NSW. 

It has prompted the state Health Department to develop the first guidelines for clinicians treating women affected by the barbaric procedure, which involves partial or total 
removal of the genitalia.
"We didn't want to be in that situation ever again."
An obstetrician specialising in the care of women with genital mutilation, Greg Jenkins, said it was often not identified by doctors until women were admitted to hospital in 
labour.
''That's really too late and it needs to be recognised earlier in their pregnancy so the opportunity for counselling and management is there,'' Dr Jenkins said. ''The difficulty is, in 
the country where they come from, genital mutilation is common so midwives there assume women have had it done and know what to do.''



Dr Jenkins works at Auburn Hospital, the only hospital with dedicated guidelines on how to care for mutilation victims. His program requires at least one senior midwife 
experienced in female genital mutilation and childbirth to be on hand at every shift. Women are assigned a midwife who they see exclusively throughout their pregnancy, with an interpreter available for those with little English.

''What prompted our guidelines was a 16-year-old girl who came into hospital in labour in 1993,'' Dr Jenkins said.
''She had quite a severe form of genital mutilation and the staff, who had never seen a case before, didn't know how to deal with it. She ended up with a nasty tear, and when 
the operating theatre consultant came in they didn't know what to do about it. We didn't want to be in that situation ever again.''



Dr Jenkins said he had not been consulted about the development of the clinical guidelines but said he supported anything that would help improve treatment. While they will not 
be mandatory, a NSW Health spokeswoman said hospitals would require ''very sound reasons'' for not implementing them.

Without specialised care, women with genital mutilation are at higher risk of birth complications, including foetal distress, hemorrhage and tearing.
One woman, who did not want to be identified, said hospital staff were uncertain of what to do when she was in labour with her second child and they saw her vagina had been 
almost closed through mutilation.

''[So] they cut [me],'' she said.
''But they didn't stitch the incision. After [I went home], I felt some of my genital tissue was sticking out and that the area was still opened wide.''
She went to see a doctor, who did nothing. ''So I lived with that condition until I had my third child,'' she said.
''The baby was big and during that labour the incision was enlarged more and I had complications. I was bleeding for 15 minutes and the midwife was anxious; she didn't realise what was happening to me.''

The draft guidelines will be released next month, when they will be considered by Local Health Districts before being implemented in early to mid-2013.

SYDNEY'S close-knit Dawoodi Bohra Muslim community is starkly divided over allegations of female genital mutilation made against some of its members, a court has heard, with debate raging in the community's online chat forums.
The revelations came during a failed attempt by a sheikh and a retired nurse from the community, who have been charged over the genital mutilation of two young girls, to have their names kept from the public.

Sheikh Shabbir Mohammedbhai Vaziri, 56, and Helen Magennis, 68, have been charged over the genital mutilation of a six-year-old girl and seven-year-old girl in separate incidents between October 2010 and July this year.

Police say Ms Magennis carried out the procedures on the two girls in suburban homes in Wollongong and Baulkham Hills while Sheikh Vaziri was allegedly an accessory - harbouring, maintaining and assisting those involved.

It is also alleged the sheikh later instructed members of the Dawoodi Bohra community to lie to police about what had happened.
Six other members of the community, including the parents of the girls, are also facing charges over the alleged mutilations.

In overturning a suppression order on Sheikh Vaziri's name and refusing to grant one for Ms Magennis on Thursday, magistrate Brian van Zuylen said there was much debate in the Dawoodi Bohra community about genital mutilation practices.

''From the [police] statement of facts there appears to be very different views from members of the community participating in chat forums,'' he said
''Some seem to be supporting the procedures while other, more moderate members are vehemently opposed.''

The lawyer for Ms Magennis, Elee Georges, said he had received instructions the ''whole community is against'' the practices. He also said he didn't expect the matter to go to trial because the medical evidence against his client was weak.

''The medical evidence, at its highest, is unable to confirm or deny [that the procedures took place],'' he said.
Mr Georges and the lawyer for Sheikh Vaziri, David Randle, argued the publication of their clients' names would prevent the defendants from getting a fair trial, and could lead to the identification of the two alleged victims.

But Mr Van Zuylen rejected the arguments, noting the public interest in open justice.

''The court isn't convinced that identifying these people would lead to an inevitable tracing back and identifying of the [alleged] victims,'' he said.
''Nor would it prevent the proper administration of justice or interfere with the opportunity for a fair trial.''

Mr Georges also said his client was suffering from a number of medical problems, including type II diabetes and osteoarthritis, and that continuing publicity of her role in the case would cause ''ongoing, significant undue distress''.

He said Ms Magennis's husband had received a threatening letter following publication of the alleged crime, and she had been harassed by the media.

''She's had people coming to her door … knocking on her back window,'' Mr Georges said.
All eight members of the community charged in relation to the genital mutilations will re-appear in court in February next year.

Four more women arrested over female genital mutilation in NSW

FOUR more women have today been arrested and charged in relation to the female genital mutilation of two young girls in NSW.

Detectives with the State Crime Command’s Sex Crimes Squad have been continuing investigations since charging a Sydney sheik, a retired nurse and the parents of the two sisters.

Detectives with Strike Force Longfield said today that they had been working closely with NSW Health and the Department of Family and Community Services.

Earlier today two women were arrested in Sydney and two women in the Wollongong area. They were each charged with prohibition of female genital mutilation.

Police will allege the four women, aged 39, 68, 73 and 77, were each present at one or both of the procedures, also known as female circumcision, performed on the two sisters when they were aged six and seven.

The women have been granted bail to face Parramatta Local Court on Wednesday 7 November 2012.

Investigations by Strike Force Longfield are ongoing, and police continue to appeal for anyone with information about female genital mutilation to come forward.
Sheik Shabbir Mohammedbhai Vaziri, 56, of the Dawoodi Bohra community at Auburn, and Helen Magennis, 68, a retired nurse of Campbelltown, and the children's parents were all previously charged in relation to the alleged acts on the girls.

MUSLIM and community leaders yesterday slammed the "barbaric" act of female genital mutilation, saying it has no place in any society.

As police appealed for public help in exposing the practice after the arrests of four people, including a sheik, lawyer Wajiha Ahmed said female genital mutilation had nothing to do with the Muslim faith.

"The Islam that I am born under does not condone violence against women and does certainly not condone any form of FGM," Ms Ahmed, 36, said yesterday.

"Most Muslims I know are offended by any such claims that FGM would be considered an Islamic act."

Police have claimed that Sheik Shabbir Mohammedbhai Vaziri, who is accused of involvement in the "genital circumcision" of sisters aged 6 and 7, told his Muslim community in Auburn to lie about its widespread practice.

Community leader Jamal Rifi said a lot of work had been done to educate religious leaders to "condemn such a barbaric act".

"I was disturbed to learn that this is still taking place in NSW after all the work we have done," Dr Rifi said.

"I know for a fact that a lot of girls are suffering because of this and will continue to suffer for the rest of their lives."

The ABC yesterday backed radio presenter Linda Mottram, who asked the vice-president of Muslims Australia, Ikebal Patel, if there should be a "controlled version of FGM available through hospitals, carefully policed and done under strict medical conditions, in order to cater for those communities that insist that this is important".

Mr Patel said he did not share that view and believed the practice was "abhorrent".

An ABC spokesperson said: "Ms Mottram was doing what any good journalist would do, asking questions of the interviewee in order to reveal his opinion about the topic."

THE concept of ''absolute freedom of speech'' can be defined as publishing wholly what one feels or thinks. The issue I take with this in Australia is the potential for vilification and defamation of a group or an individual's beliefs. As a proud migrant, I brought my personal beliefs from my country of birth, Pakistan. Like many others who came to Australia, we all bring our individual points of view that create a rich and diverse society in which we seek to live without fear of reprisal.

In Australia we ensure that these views and beliefs are respected and protected through statutory channels at state and federal level. We can write publicly what we believe in. We do not have strictures on what websites we may visit, for instance. Our government does not interfere with what we are allowed to know about the world. Such freedom from censorship must be protected, but this must occur within reason.

I do not suggest we should be so restricted on our personal opinions by law that it may promote an abuse of process; for example, the blasphemy law in Pakistan, under which uttering a word or an action can be considered to be against Islam and attracts the death penalty. The recent assassination of the Governor of Punjab province, Salman Taseer, who openly stood up against this law to protect minority groups such as Christians is just one example of bigotry created by the law.

The case of Catch the Fire Ministries in the Victorian Court of Appeal, on the other hand, is an example of a group found to have contravened the state's Racial and Religious Tolerance Act, among other statutes, by virtue of certain publications against Islam. The group argued that it had a right to express its points of view and beliefs.

I suggest that the decision confirmed we should respect all persons and their beliefs without vilification or discrimination. To protect our right to belief without fear, I believe we should not have an absolute freedom of speech.

What is Taqiyya  (pronounced tak-e-ya )

But, Islamic terrorists have their own terms: taqiyya (pronounced tak-e-ya) : precautionary dissimulation or deception and keeping one's convictions secret and a synonymous term, kitman: mental reservation and dissimulation or concealment of malevolent intentions...
Taqiyya and kitman or 'holy hypocrisy' has been diffused throughout Arabic culture for over fourteen hundred years since it was developed by Shiites as a means of defence and concealment of beliefs against Sunni unbelievers. As the Prophet said: 'he who keeps secrets shall soon attain his objectives.'
The skilful use of taqiyya and kitman was often a matter of life and death against enemies; it is also a matter of life and death to many contemporary Islamic terrorists. As so often in the history of Islam, a theological doctrine became operational.
During the Spanish inquisition, Sunni Moriscos attended mass and returned home to wash their hands of the 'holy water'. In operational terms, taqiyya and kitman allowed the 'mujahadeen ' to assume whatever identity was necessary to fulfill their mission; they had doctrinal and theological and later jurisprudential sanction to pretend to be Jews or Christians to gain access to Christian and Jewish targets: 'the mujahadeen can take the shape of the enemy'.
According to Christian ethics lying is a sin; In Islamic jurisprudence and theology, the use of taqiyya against the unbelievers is regarded as a virtue and a religious duty.

Like many Islamic concepts taqiyya and kitman were formed within the context of the Arab-Islamic matrix of tribalism, expansionary warfare and conflict. Taqiyya has been used by Muslims since the 7th century to confuse and split 'the enemy'. A favored tactic was 'deceptive triangulation'; to persuade the enemy that jihad was not aimed at them but at another enemy. Another tactic was to deny that there was jihad at all. The fate for such faulty assessments by the target was death.

A SYDNEY sheik accused of involvement in the barbaric "genital circumcision" of sisters aged 6 and 7 is alleged to have told his Muslim community to lie about its widespread practice.

Police claim Sheik Shabbir Mohammedbhai Vaziri told members of the Dawoodi Bohra community at Auburn to lie to police when they questioned them over the mutilations.

Vaziri, 56, of Auburn, Helen Magennis, 68, a retired nurse of Campbelltown, and the children's parents have all been charged in relation to the alleged acts on the girls.

Police allege the procedures were carried out by Magennis.

A strike force of seven detectives from the NSW sex crimes unit was set up after an anonymous tip to the Department of Community Services several months ago.

It is the first time anyone has been charged with the offence in relation to children after legislation was passed in 1994.

A MAN has appeared in a Sydney court charged over the genital mutilation of two girls aged six and seven.

Family and Community Services Minister Pru Goward said she did not believe genital mutilation was rare in NSW.

Ms Goward said that female genital mutilation was an "abhorrent practice" and "a form of child abuse".

The two children are still in the care of their parents.

"They are good parents," NSW sex crimes unit head Detective Superintendent John Kerlatic said.

"It may seem a contradiction to say that when the parents are facing such serious charges. But they are not in any danger of any physical abuse."

The alleged genital mutilations occurred in the past 18 months at homes in Sydney.

Vaziri appeared in Burwood court yesterday on two counts of being an accessory after the fact to female genital mutilation, and hindering the police investigation.

Police allege Vaziri hindered the investigation by telling people to lie about the extent of female genital mutilation.

Magistrate Chris Longley said despite what many people would see as very serious charges, he was granting bail under strict conditions.

He said police opposed bail saying Vaziri was a flight risk.

Mr Longley ordered Vaziri surrender his passport and report to Auburn police daily and appear in Parramatta Local Court on September 26.

The parents were charged last Friday, granted bail and ordered to reappear in court on September 26.

Magennis is alleged to have carried out the procedure and was granted bail to reappear on October 3.
