Australian Federal Election 2013: Abbott to scrap asylum appeal process

Coalition to scrap asylum appeals process

The Daily Telegraph
August 16 2013

TONY Abbott has given his clearest time frame yet as to when he will be able to stop the boats should he be elected prime minister on September 7.

The opposition leader today said that by the 2016 election levels of boat arrivals would be back down to the last days of the Howard era when there were just three arrivals a year.

"That's my confidence," he said.

"Obviously idea is having zero boats but if we were able to get it down to three boats a year that would be a good thing."

More than 50,000 Illegal VOTE people have arrived on boats under Kevin 07/ Gillard/Kevin 07 Labor/Green Loon Independent / "Co Party Government"

Mr Abbott and his immigration spokesman Scott Morrison today unveiled more detail on the Coalition's border protection policy, as revealed by News Corp Australia today.

Under the Coalition plan, anyone who arrives in Australia illegally by boat will not get permanent residency, including more than 30,000 people already here.

Anyone arrivals "reasonably believed" to have destroyed their documentation would not be accepted.

A new assessment process, based on a UK model, would see faster removal of illegal arrivals.

Those found to be refugees would be granted temporary protection visas.

They would not be allowed to bring their family to Australia or convert the TPV to permanent residency.

The TPV would last three years after which holders would have to apply for another visa if it was not safe to return home.

They would be required to work for the dole.

The Coalition has also pledged to scrap a $58 million detention centre planned by Labor for Singleton in NSW.

Tony Abbott channelled his predecessor and mentor, former prime minister John Howard by saying that Australians "were in charge of this country and we'll decide who comes here".

However the Opposition Leader could not rule out that asylum-seekers given refuge in Australia on temporary protection visas would not one day be permitted family reunions.

"I can't say what might happen in ten, twenty, thirty years time," Mr Abbott said.

"But what I can say is if you come here by boat you should never expect to get permanent residency.

"If you turn out not to be a refugee you will be in detention, that's where you'll be. If you are a refugee you will be on a temporary protection visa and you should expect to be on it indefinitely."

Mr Morrison said he was confident the new process would stand up to any future court challenges.

"This is a complicated and detailed area," Mr Morrison said.

"I am very confident that we will get this as right as it can be."

COALITION TO SCRAP ASYLUM APPEALS PROCESS

The removal of failed asylum seekers from Australia would be dramatically fast tracked under a hardline Coalition plan to send them packing in as little as three months.

And any of the 30,000 boat arrivals already in the country who have been found to be genuine refugees would denied a permanent visa.

The Coalition would also scrap plans for a detention centre at Singleton in the NSW Hunter Valley, where Labor plans to house more than 1000 people, and divert almost $60 million to build 2000 places it has promised for offshore processing in Nauru.

Opposition immigration spokesman Scott Morrison plans to adopt a hardline UK-style removal regime and to scrap the refugee review tribunal.

ASYLUM SEEKERS FIND THEIR OWN SOLUTIONS

Asylum seekers would be "triaged" and those considered unlikely to be found to be refugees taken into detention, pending a review by up to two departmental case workers which could take as little as 28 days.

The removal process would be modelled on a scheme in the United Kingdom called Detained Fast Track, Mr Morrison said.

Those considered unlikely to be refugees would have their first assessment inside detention finished within 14 days and if it found against them they would then be able to access a 14 day review by another case worker.

PNG HAS ROOM FOR 10,000 ASYLUM SEEKERS - RUDD

The process would take no more than three months, a Coalition policy document shows.

A failed review would result in the government seeking travel documents in order for the person to be removed.

Failed refugees from countries, such as Iran which refuses to accept involuntary returns, would be left on the Christmas Island indefinitely.

"If there are issues with them being removed from the country we will send them to Christmas Island until they can be removed," Mr Morrison said.

PNG LOOKS AT ASYLUM SEEKER JOB SCHEME

Mr Morrison said the 30,000 asylum seekers who arrived before Prime Minister Kevin Rudd's announcement of the PNG Solution, and who are waiting in the community for their refugee claims to be processed, would be made to work for welfare payments.

They would all be moved onto temporary protection visas for up to three years and given work rights with a work for the dole style regime used in cases where they were unable to secure a job.

Asylum seekers could also be directed to regions where more work was available.

The temporary visas would prevent them bringing family to Australia and if they chose to leave they would be barred from returning, in a policy mirroring the Howard Government's temporary protection visas.

"They won't get a protection visa from us, they will be desperately hoping a Labor government gets elected," Mr Morrison said.

He said a Coalition government wanted to scrap the refugee review tribunal to help achieve its policy of "getting out of the country" people rejected as refugees under its single case worker review model.

Courts and tribunals have overturned up to 80 percent of departmental decisions to refuse a protection visa and cases have had to be re examined, Mr Morrison said.

"Our objective would be to get back to a single case officer decision and review system," he said.

In addition to other hard line measures, boat arrivals who came without paperwork would be rejected as refugees if it was found they had deliberately thrown their identification out.

About 90 per cent of people have arrived without paperwork at times under the current government.

The Coalition says the investment in a new detention centre for Singleton wasn't needed.

"Under the Coalition, offshore processing will be done on Nauru and PNG, not in Singleton," Mr Morrison said.

"That's why we will shut down Labor's plan to spend almost $60 million at Singleton and create that capacity where it's needed offshore.

"Kevin Rudd is making more room for people coming illegally on boats in Australia, at places like Singleton than he is offshore on PNG."

Mr Morrison said scrapping Singleton would allow the Coalition to fund plans it announced last month to house an extra 2000 asylum seekers in

Nauru, including accommodating refugees in refurbished homes in the nation's slum district while Australia searched for third country resettlement options.

Almost 2500 asylum seekers have arrived in almost a month since Mr Rudd announced his PNG solution with only a few hundred sent to Manus Island after health checks so far.

Single adult men have been sent to the remote island while the government works to bring accommodation up to standard for families.

More than 50,000 people have arrived on boats under Labor.

Australia's Dear Leader,Lu Kewen aka. Kevin 07 insults Australia's finest with claims of he too had "gone outside the wire" in Afghanistan.

Prime Minister Kevin Rudd relives war stories during visit to troops in Townsville

Daily Telegraph
August 13 2013

SPEAKING to troops in Townsville, Kevin Rudd told his own war story about how he too had gone outside "the wire" into the danger zone in Afghanistan.

Casting himself as a Prime Minister who had ventured beyond safe Australian bases in the war-torn country, he said he had "gone out" into the field once or twice.

Mr Rudd made the remarks after thanking 100 soldiers at Lavarack Barracks for their service to Australia and he promised to do more to help their comrades who struggle to return to civilian life.

Many raised their hands when he asked who had served in Afghanistan.

He urged them to visit the War Memorial in Canberra to see the latest exhibition on the Afghanistan War, which has claimed 40 Australians, including four who were based at Townsville, and shared his own experience of the conflict.

"If you get down to Canberra have a look at the new exhibit on Afghanistan," he said.

"The War Memorial has got the best piece of what I would describe as live action film of what it is like to be in the field in Afghanistan ... right at the point of engagement with the enemy.

"I was just taken aback, I have been to Tarin Kowt many times, probably five or six times now, and I have been basically behind the wire, once or twice I have gone out."

He said the exhibition "reminds us that this was not the odd angry shot - Afghanistan - this is a real, hard-fought war on the ground."

Mr Rudd's spokeswoman said he had ventured outside an Australian base during a three-day visit as Foreign Minister in March 2011.

The spokeswoman said Mr Rudd, who visited an Australian base with his wife Therese Rein last month, saw the work of troops during the time in the field.

Australia's Dear Leader, Lu Kewen aka.Kevin 07 (r) seen here with Consort Madame Rein (l) on the front line in Afghanistan earlier this month.

After a tour of the Townsville on Tuesday in which he inspected a camouflage exercise and two Light Weight Howitzer gunners, he asked the soldiers to gather so he could thank them for their bravery.

"For all of you here and through to your comrades still in Afghanistan, another reason for coming here today is just to say thank you for the work that you and the Australian Defence Force have done in all of our name in Afghanistan," he said.

"As you know, in Afghanistan, 40 of our best and bravest have not come home, 250-odd have been wounded."

Referring to Private Benjamin Ranaudo, Private Matthew Lambert, Captain Bryce Duffy and Lance Corporal Luke Gavin, he said: "And you've lost four or five here from this very base at Lavarack and we remember them today as well."

Mr Rudd made the visit after campaigning at a nearby childcare centre in the LNP-held seat of Herbert, which is on a 2.2 per cent margin, where he pledged $30.6 million to train more childcare, disability support and aged care workers.

Lu Kewen aka. Kevin 07 caught CHEATING !!! Did he really think no one would notice?

Election debate: Kevin Rudd accused of cheating after using notes during debate

Patrick Lion
Daily Telegraph
August 11 2013

KEVIN Rudd has been accused of cheating during the leaders' debate after using speaking notes to help him against Tony Abbott.

The debate's moderator, Sky News political editor David Speers, revealed following the debate that the Prime Minister had used the paperwork against the rules.

Footage of Mr Rudd shows he was holding a pile of papers and he appeared to repeatedly reference them while talking.

Economy dominates leadership debate

Lacklustre affair offered nothing new

But Speers said he had not noticed during the showdown as he was focusing on his own job moderating and asking questions.

According to the rules signed off by both parties and issued by the National Press Club on Friday, both Mr Abbott and Mr Rudd were prohibited from having pre-prepared paperwork.

"The leaders may have a pen and paper on the lectern and no other documentation or props,'' the rules state.

In the debate wrap up, Speers said: "Kevin Rudd had notes. That wasn't allowed under the rules.''

Liberal frontbencher Andrew Robb later seized on the issue, pointing to the Prime Minister's claims the election was about trust.

"Mr Rudd said this election is about trust and the first thing he did was cheat," Mr Robb said.

"He broke the agreed rules about no notes. I think Tony Abbott looked like a leader and Kevin Rudd look a reader."

The Prime Minister's office did not respond to inquiries last night but he had joked before the debate about his preparations on Twitter, where he posted a photo of himself surrounded by paperwork.

"I have lots of official briefs for the debate," he tweeted.

"Does anyone have some good jokes? KRudd."

Commentators panned Mr Rudd for looking down at his notes during the debate and not speaking frankly off-the-cuff.

Labor figure Graham Richardson said: "If I was Kevin Rudd, I would sack whoever wrote them."

Sky News commentator Peter Van Onselen declared it "cheating" and said it was "outrageous" - even if it was a silly rule in the first place.

"The rules are laid out and both leaders have agreed to it ... it is a disadvantage to Tony Abbott," he said.

"Kevin Rudd cheated."

A spokesman for Mr Rudd said: "There was absolutely no intention to do anything other than comply with the rules.

"The PM arrived at lectern in full view of the audience and the panel. There were no objections raised at any time.

"We have always believed this rule is aimed at preventing the use of props.

"The PM is happy to debate Mr Abbott at any time during the election campaign without notes."

The Heiner Affair just wont go away

Heiner Affair inquiry getting down to business

Piers Akerman
Daily Telegraph
Wednesday, April 24, 2013 (12:06am)

It would seem that Prime Minister Julia Gillard is not the only Labor figure to reach for the “naïve” defence when the hard questions are asked.

Yesterday, Dean Wells, a former Labor Attorney General in the Goss government, told the Queensland Child Protection Inquiry which is looking into the Heiner Affair that the Cabinet decided to shred internal documents because they were inexperienced and wanted to protect employees from defamation.

He said the 1990 order to destroy documents from an investigation into a youth-detention centre was the Cabinet’s baptism of fire as the first “damned if we do, damned if we don’t” decision.

He is the third Cabinet minister to be summonsed to the inquiry - the first under newly expanded terms of reference - that is investigating the long-running Heiner Affair disgrace.

“We had been out of office for 32 years,” Wells said.

“We did not know what was normal and within the area of the Cabinet’s concern.

“What we did know that a minister had a problem that an inquiry that had been established by her predecessor had been pulled up.”

The Heiner Affair centres on the destruction of documents from retired magistrate Noel Heiner’s investigation into allegations of mismanagement at the John Oxley Youth Centre.

It later emerged a girl, 14, was raped at the centre in 1988 and claims grew of a coverup of sexual abuse allegations.

The girl, now a woman, at the heart of this matter, still wants justice.

She was awarded approximately $140,000 in a hush-hush ex gratia payment or possibly compensation in June, 2010, by the Bligh Labor government.

Commissioner Tim Carmody asked why the government would offer to indemnify a man, then destroy the documents which might be produced in a court in a case against that same man.

“That suggests no one thought about those two colliding facts,’’ he said.

Wells said the government believed it wrong to keep documents which he believed contained untested allegations of misconduct which did not involve criminal behavior.

But Carmody said the Cabinet knew it was dong something quite “risky” which required serious thought.

“It was such a serious decision it was deferred twice,’’ he said.

Yet the Cabinet did not appear to apply careful consideration before green-lighting the shredding.

“It (the consideration given) seems to have been less than might have been expected,’’ Carmody said.

“The questions that seems to have been obvious don’t seem to have been asked.’’

Carmody suggested the documents contained not so much allegations of child sexual abuse but accusations related to industrial strife inside the John Oxley centre.

But he also suggested there were two competing sides in the equation - one side wanted to keep the material and one side wanted it destroyed.

He suggested the Labor Cabinet had taken one side, and allowed the destruction of the documents.

The inquiry continues and the commissioner is due to decide on the criminality of the shredding of the documents on May 6.

In as much as a number of the most senior judges from across the nation have in the past decided that the shredding of documents foreshadowed to be needed as evidence was prima facie a crime, Carmody’s decision will be eagerly waited.

The Heiner Affair has never been properly investigated despite 11 reviews and it has cast a shadow over the Goss Cabinet and a number of senior public servants including the former prime minister Kevin Rudd, who was Premier Wayne Goss’s chief of staff and later director-general of his Cabinet office.

It may be that the Newman government will finally see justice done in this long-running scandal.

Beijings most senior representative in Australia,Lu Kewen aka. Australian Labor PM Kevin 07 Rudd, vows to continue Labor’s WAR against Australia’s “working families”

It's not over: Rudd vows to fight for emissions scheme

SMH
April 24, 2010

Climate change is still on the agenda, write Phillip Coorey and Peter Hartcher.

KEVIN RUDD says the great moral challenge posed by climate change is undiminished and he will keep trying to implement an emissions trading scheme if Labor is re-elected.

The SCAM Exposed AGAIN.

Al Gore has made $500 Million, so far, out of his and the UN’s Anthropogenic Global Warming SCAM.

How much has Comrade Lu Kewen made ?

Australian’s will  pay an extra 64% (before 2012) on their electricity bills BEFORE the UN’s and Lu Kewen’s aka. Kevin 07 Labor Party’s, Anthropogenic Global Warming TAX is implemented.

"The whole aim of practical politics is to keep the populace al  armed (and hence clamorous to be led to safety) by menacing it with an endless series of hobgoblins, all of them imaginary."

"The urge to save humanity is almost always a false front for the urge to rule "

H. L. Mencken

In an interview with the Herald, Mr Rudd rejected growing criticism that he had abandoned the climate change cause because it was no longer a vote winner after the Copenhagen conference and the defeat of his emissions trading scheme.

"It's very clear cut that whether climate change is topical or not, whether it is popular or not, the reality of it does not disappear," he said.

"This remains a fundamental economic, environmental and moral challenge. Whether it's newsworthy or not in a particular season is beside the point. We haven't changed our view of this.''

The Senate has twice blocked legislation for the emissions trading scheme. The legislation is again before the Parliament but the Senate has delayed debate until at least next month and there is next to no chance there will be a vote before the election expected in the spring.

Mr Rudd said that if he is re-elected, he will try again to have a scheme introduced but it would depend on the make-up of the Senate.

''We've got to ensure that we act on climate change and we do so always within the scope of our powers. We maintain our position that this is part of the most efficient and most effective means by which we can reduce greenhouse gas emissions with the least cost to the economy.''

Mr Rudd can use the twice-defeated emissions trading scheme as a trigger for a double dissolution election. While coy on that prospect, he said he would have no problem advocating an emissions trading scheme during a campaign.

He said Australia was playing a key role in trying to forge meaningful international action to reduce greenhouse gas emissions: ''National action in the absence of global action doesn't add up to a row of beans.''

He did not agree Copenhagen was a failure. It had produced an accord that temperature increases should not exceed 2 degrees, he said. In the past three months, Australia had been working intensively to get countries to sign up. So far, 74 countries, producing 80 per cent of the world's emissions, have pledged to reduce emissions by 2020.

Mr Rudd spoke to the Herald the day after his meeting this week with the premiers and chief ministers on health - and the day before the government broke its promises on insulation and childcare.

Mr Rudd had promised to put a health plan to the states by mid-2009; then he asked them to accept the plan or face a referendum at the 2010 election.

He said it was unfair to accuse him of breaking a promise just because the health plan was not presented until early March.

''I can never quite understand the criticism from Abbott and others at the time about why there is a six-month delay,'' he said.

''For goodness sake, 12 years of [Howard government] inertia and after two years we've decided to take a further six months to consider the implications for such a big reform, the biggest since the introduction of Medicare.'''

The West Australian Premier, Colin Barnett, has refused to sign the heath deal because he does not want to give the Commonwealth 33 per cent of his GST revenue. He will sign up if his state can contribute the money to the reforms independently.
